Ripoff House preservation fraud and charges

Hi everyone! Here is our GAMC story.

House fire, insurance paid to Bank of America, B of A sells mortgage to GMAC. GMAC reapirs house, received a quote from Superior home services for $95,000 to complete repairs as listed on the adjustors report. SHS hires contractor to repair house based on adjustors report.

Repairs are done and there are $35,000 worth of repairs not done but we are told we have to pay for. The house is on foreclosure and we are trying to sell. We send pictures and documentation to GMAC stating we are not going to pay the full preservation fee, the are charging us for a fridge that is not there. They called the day of closing and said they reviewed our information and did not find any basis to chage the preservation fee. I want the fridge I paid for, the 3 levels of hardwood floors, the $4,000 sauna that I paid for and all the appliances in the kitchen I paid for.

Does anyone know if GMAC or the contractor can be taken to small claims court for these items that we had to pay for and did not receive? Also a 9 year old girl was passed away in the fire, so not only is there emotional heartache, GMAC has the nerve to add salt to such an open wound.
