Ripped off by Countrywide representitive, told there would not be any prepayment interest penalties!

I was completely mis-led by a Countrywide rep. I was called by Countrywide to see if I would like to refinance my home loan. Since I was already with Countrywide she said it would be a piece of cake. The original loan I had was sold to Countrywide about 6 months after I got it. I knew I had to wait 2 years to refinance otherwise I would be charged prepayment penalties.
I told the rep this and she said, "No problem, since you are still going to be with Countrywide, we won't charge you those pre-paymnet penalties". I was surprised and said well as long as I don't get charged the pre-payment penalty fees then it would be worth it to me to refinance. My loan closed at the end of November.
When I went to look closer at the paperwork for my taxes I realized they did charge me for the pre-payment penalty $3,600.00. I called the rep and told her I was charged the pre-payment penalty fee and she acted as if I should have known that. I told her I would not have refinanced this loan had there been any penalties because my 2 years were up in 6 months and then I wouldn't have to pay the fees.
She proceeded to tell me she never told me that and she would have never told me that. I said you snowed me, you know I didn't want that loan if there were pre-payment penalties and she said well at least you can write it off on your taxes. I was so angry. I want to know if I can at least go to Small Claims court for my $3,600.00? Does anyone know if that is possible? Or does anyone have any ideas as to what I should do?
