I recently received a summons to go to court over a loan that I had taken out in 1999. I had included this loan in my bankruptcy in 2003. Since I have not heard from Wells Fargo because I assumed it was discharged. They never came to the hearing or contested the discharge. Now, three years later they are taking me to court and stating I signed a education promissory note, and it is not dischargeable. I contacted Wells Fargo and advised them that the promissory note is forged it is not my signature, I never received a student loan. I had taken out a personal loan. Even my co-signers signature is forged. The original loan was provided by Bank One, however it as been sold a few times, and finally into the hands of Wells Fargo. I don't know who signed the note, but it wasn't my co-signer or myself. I tried to contact Wells Fargo, however all they keep telling me is that it is your signaure, and they can't help me. They don't even want to get to the bottom of it.
