I tried to resolve this issue in a diplomatic matter with Juan Carlos Hernandez, only to be lied to and given the runaround.initially, I never wanted this issue to escalate to where it has, so I hold Action Financial liable for the consequences that are brought upon them.

The story...

I clearly laid out the mortgage plan that I wanted, and I was told by Juan Carlos Hernandez that he could match that plan and probably even provide me with something better. That was clearly not the case. At the time of closing, I was assaulted by these predator loans that benefited only Action Financial. I had to change many future financial plans such as my wedding, due to the unforeseen large down payment required at closing. My initial mortgage plan was completely distorted by Action Financial, at the closing table.

One of the worst conditions on the loan that was provided to me is the hard three year pre-payment penalty. Once again, I clearly told Action Financial that I did not want any pre-payment penalties, let alone a HARD three year one! I am now forced to pay about ~$6,000 when I sell my property, and therefore I am tied to it for three years. This is not my "dream home, " I don't plan to live here for three years!

Another condition on my loan that just blew my mind was the altered good faith estimate that was faxed to me at the time of closing, which was notoriously hard for me to get a hold of prior to that moment. Were these guys on drugs? The numbers don't even add up! The origination fee was introduced in the document with brute force, even after it was agreed by me and Action Financial, that this fee would not be introduced.

You may ask why I closed under these circumstances. Well, I tried not to. First I was threatened by Juan Carlos Hernandez over the phone. He clearly told my closing agent "Tell them that I will take him to court if he does not close" and then he rattled on stating that he would make me pay for all of his "cost of doing business" fees. Also, I explained to the developer that their "preferred lender" is a crook, and that I wanted to be given an extension, so that I can find a decent lender. They told me that they could not do much for me, because the closing date could not be changed. Finally, the developer had $10,000 of my money, $8,000 for the initial down payments, and $2,000 in upgrades to the property. As per the developer's contract agreement, I would have forfeited this money if I did not close. Faced with these conditions, I was forced to close. I ended up hurling in the title company's restroom, from how pi*ed-off I was.

I had asked for a good faith estimate many times, but was always given the runaround and was never provided with one. I was not sure if they were doing this maliciously, or if they were just neglectful. I had a bad feeling about Action Financial, but I guess I was too naive and trusted them.

These people are crooks! Do not ever consider using them as mortgage brokers.
