In July, I called Centex Home Equity to make my July payment in two separate checks. The woman helping me told me that she made a mistake and needed to void the first payment. I then gave her the next two check numbers to complete the transaction. Before we hung up, I asked her three times if she voided the first check and three times, she told me yes. Within a week, my bank account went completely overdrawn because she did not void the first check as indicated, so I made a double payment to Centex for July. I called Centex repeatedly, until I was transferred to someone who could help me, and when this error was discovered, I received a check from Centex several days later via Fed Ex as reimbursement. Because of this error, my bank account was overdrawn with check charges totalling $233.00. I spoke to the bank fraud liason office, and when they saw that the same exact amount was withdrawn and reimbursed, they removed the $233.00 overdraft charges. I gave my bank copies of the reimbursment and documentation from the bank fraud liason office, however, my branch manager told me this was still all my problem, and that my bank account had been noted, that I was problem. All the copies of everything I gave her was thrown away and not put in my file. I went back to Centex and asked them for a letter of explanation for my bank and reimbursement for the overdraft charges. Approximately, a month later, I received a check for $233.00, but Centex refused to give any letter of explanation.

I have multiple sclerosis, and am on permanent disability. I pretty much live on a fixed income. I explained this to Centex, but they apparently thought this was a joke. I started getting between 10 to 15 phone calls from Centex every day wanting to know if they could do a refinance for me. Even though it now February, these phone calls continue.

In November, we tried to refinance our first mortgage. It was a better interest rate and would have paid off quite a bit of debt. When my lender filed the Subordination Agreement with Centex, the problems flared up again. Centex is in the second position on my mortgage, that would not have changed. Our Subordination Agreement sat in the Centex mail room for over a week before it was sent to the correct department. Whenever anybody tried to call to get the status, we were told that only one person could help us, and every message that was left for her was never returned. After about 10 days of this, Centex started calling here again and telling me that they would deny my Subordination Agreement unless I gave them first shot at the refinancing. Every time I told them "no" and to leave me alone, I was told that they would make sure our loan wouldn't go through. During this time, we signed loan documents with the new mortgage company twice, Centex continued to harass me, and just recently, we found out that continued to run our credit without authorization.

I have filed complaints with the FTC and California Department of Corporations, but they probably won't do anything.

Anybody out there that is looking for a home equity loan, please steer clear of Centex.
