Ripoff, Trying to forclose, will not return phone calls

We fell behind on our payments with Homecomings Financial for Multiple reasons. We owed 3 payments, we phoned them to find out exactly how much we owed and where we needed to overnight the cashiers check.
They received our check in Nov. 2005... Held it until Dec. 2005 when they supposedly returned it, although we have never received it. They started forclosure processes even though if they had applied our check to our loan, we would have been current.
They will not return phone calls or emails. I would be interested in any class action suit that comes about. We are going to contact our attorney first thing tomorrow.
