Kept a good faith deposit on home without disclosing it was near a dumpsite and won't return deposit, ripoff

I found a house i was interested in purchasing. I put a good faith deposit down on the home. I went to look at the property and a neighbor came by and told about the dumpsite.

When i went back to take pictures of home for insurance purposes in the spring could not be outside due to the smell coming from the dumpsite. The neighbor told me it was worse in the summer with the warm temperatures. He said i would have to stay in the home with the air conditioning, which this home did not have. He also said in the summer the smell would burn your eyes it was so bad.

I called the above mentioned person to put a stop to the purchase and he informed me that they were keeping the good faith money because the house was still livable, even though the odor outside was so bad you would have to stay indoors with windows closed.

Mr. Adaszewski informed me that this was how they are handling my good faith deposit, by keeping it. The dumpsite however was not noted on the disclosure papers that i received.

I have children and grandchildren who spend a great deal of time at my house and this is not a livable situation for me.
