I received an offer from Capital One for a personal loan several years ago; these offers came in the mail (unsecured personal loans) and was by invitation only. After the economy and housing market went bust, Capital One started to do "account reviews."
Capital One noticed that I had fallen behind on some bills and then I noticed my personal loan was appearing on my husband's credit report. I contacted Capital One and told them about this and they told me he was a co-signer. So, I challenged them and asked for a signed contract - which they could not and would not produce. However, I had a copy of the cancelled loan check with only my name and signature on it.
I contacted the BBB, OTC and FTC and filed complaints against Capital One. Capital One insists they did nothing wrong. What happened here is Capital One got nervous about not being paid and they tacked my husband on but what they don't understand is that this is an unsecured loan and if we went to court, no judge is just going to take Capital One's word for it that my husband is a co-signer with a signed loan application.
It is unreal what some creditors will do and get away with.
