Scottsdale, Arizona (Civic Center Station - 3700 N. 75th St.) motorcycle cop, James (Jay) S. Rusch is in violation of a court order by not paying in full, his court ordered child support obligation. He has not paid in full his child support medical obligation for 1995,1996, 1997,1998, 1999 and 2002. He has not paid in full his child support modification obligation for April 1998, May 1998 and June 1998. He has not paid in full his child support modification obligation for April and May.

In spite of repeated written requests including a letter sent to Chief Bartosch, City of Scottsdale Chief of Police, dated July 22,1998 these obligations continue to go unpaid. Deputy Chief of Police, Kevin Mattingly responded with a letter of acknowledgement but directed the matter back to Superior Court for child support claims.

Court records dated 1998 and 2002 show that James (Jay) S. Rusch has not exercised his visitation of his three children. Mother has incurred costs of approximately $26,950.00 at $350.00 per month for approximately seventy seven (77) months. This is based on increased expenses after he abandoned his visitation obligation in March of 1996.

James (Jay) S. Rusch owes $1,949.92 in child support modification and medical expense obligation.

James (Jay) S. Rusch claims tax exemptions for two of his three children. According to the Child Support Modification paperwork, he is eligible for these exemptions only if the TOTAL child support obligation is PAID IN FULL for the year claimed. James (Jay) S. Rusch has not paid in full his child support obligation for 1995,1996, 1997,1998, 1999, or 2001 therefore he was not eligible to take the exemptions.

Court records show that James (Jay) S. Rusch re-married his second wife in March of 1996 prior to a divorce from his first wife in May, 1996. Years later court records reflect a change in the date of the May 1996 divorce back to September 1995 to accommodate the second marriage as James (Jay) S. Rusch was not aware he was not yet divorced when he re-married.

SO, besides James (Jay) S. Rusch not paying his court ordered child support, he was/is technically a bigamist, until he used his power/influence as a Scottsdale Arizona Police officer to fix the divorce record. I have the proof, the papers between our attorneys still negotiating our divorce well after James (Jay) Rusch remarried. This could even involve judicial misconduct by the Superior Court Judge who actually changed the record.in October of he had our divorce moved back to the year 1995, when we were divorced in 1996. I immediately wrote to the court when I discovered the falsified date change. To this day, I have never received a response.

Why is the Scottsdale Police Department not doing anything about this? Most police departments would not allow a dead beat dad to get away without paying this much money in child support, and his falsifying records to avoid being prosecuted as a bigamist.

Since I am at my whit's end and cannot afford legal fees, I have decided to file my consumer complaints and take my message to the street, literally.

Working the system rather than enforcing it. Is this any way to protect and serve, Officer Rusch?
