I was rear ended by an uninsured motorist in June. I had previously had neck surgery almost 2 years prior to the accident, having a titanium plate placed in my neck. The accident caused severe pain and depression from my neck injury. I had been fine after the surgery until I was in this accident. I had never filed an insurance claim before, and I told the adjuster this.
I asked if I needed an attorney and he said no, they (progressive) were on my side and working for me because I had uninsured motorist insurance covering me up to $13,500. I had to quit my job due to my physical health, and depression. I took therapy and went to doctors as Progressive requested. My diagnosis was not good and my bills were not being paid. The claims adjuster said the max they could pay would be $5,000. When I mentioned an attorney he said that I would get less than that because the attorney would take 30-40% of the $5,000. I was backed in a corner and didn't have a clue as to what to do.
I know now that I should have gotten an attorney but I feel that I was misrepresented by the claims adjuster when he told me that he was working for me, since the accident was no fault of my own, and that the money paid to me by Progressive was no loss to them because they were going after the person who rear ended me. Needless to say I have constant pain and can not work, can not afford the test needed to diagnos what is wrong and I am screwed. I had to move to my mothers due to my physical health, and called Progressive to report my change of address, and they said due to my zip code my rate increased almost 2x as the previous premium.
I moved from a very high population to little town with little or no crime. Traffic is unheard of, and the population is probably not an 1/8 of where I used to live. My advice to anyone who reads this is to always have aa attorney represent you when dealing with any insurance company. They are not concerned for the consumer's well being at all. It's just the premium they care about. And back a person in a corner and financial ruin until they can force them into an agreement that best benefits them.
Physically, mentally, emotionally, and finacially ruined for life.
